Changes to Pre-Order Page

I got on their chat and asked, specifically, "Will the timing of upgrading our reservation to a preorder affect where we land within our assigned window?"

Kylee F. responded, "To my understanding it will not."

That's consistent with the logical approach of giving people 30 days to lock in the priority they were granted by virtue of their reservation, and it's really the only reasonable and considerate way to work it. That said, I'm still likely to be syncing my watch at https://time.gov/ and readying my F5 key, but hey.

(Earlier in the brief conversation, she also said, "That delivery window you see tomorrow is based on when you reserved initially." I figure we all already knew that, but may as well put it on the record here.)

that was my understanding also.
Mine too, but then they put up this confusing change of language.

Re-reading the new language, I think what they are trying to say is the sooner you pre-order, the sooner you lock it in, not that it changes priority. This comports with what your agent said.

Doubt it. The reservation fine print specifically prohibits this. I'd expect similar language when you press the pre-order button.
Let's talk about that agreement for a minute. https://www.slate.auto/en/terms/reservation

It says:
6. Cancellations/No Resellers

You can cancel your Reservation at any time prior to placing an order and receive a full refund of your Reservation Fee via your Slate account or by contacting us at https://www.slate.auto/en/contact. Your Reservation Fee will be credited back to the method of payment used to place the reservation. Slate sells directly to consumers. By placing a reservation, you represent that you are reserving the Truck for your own use and understand that Slate may cancel your reservation if it determines, in its sole discretion, that you are reserving a Truck with the intent to resell. Slate will not accept resale certificates for Trucks. Slate also reserves the right to decline or cancel a Reservation for any reason.
So it is tilted to selling your spot in line. However, also note that the agreement gives Slate sole discretion to cancel it. When you reserved, you used your name. Changing the name would likely have them look into it further. Finally, we agreed to an arbitrator in lieu of court. Guess how an arbitrator might rule? It would not be likely to favor the buyer. But IANAL, so YMMV.

I am worried that if after I reserve with a non refundable deposit, that if I don't like the Slate for whatever reason, if I can't get a refund, be able to transfer it to another family or friend.

Yes, many of us have expressed the same. You will not be able to get a refund, that is for sure as their FAQ specifically says so. As for transferring... who knows? Based on the reservation language, it seems unlikely.

Let's see what the official legalese says tomorrow.

It would make no sense to shape the already complex logistic hurdles around delivering 100k vehicles by prioritizing who pressed "buy it now" first.

I could be wrong, but I think they're smarter than that.

As for transferring... who knows? Based on the reservation language, it seems unlikely.

Let's see what the official legalese says tomorrow.
I would be shocked if they would allow a preorder to be transferred. I'm absolutely certain that would not be allowed for the same reason they have the language in the reservation: scalpers.

It'd be a shame to lose $300 if you get on the preorder list and then have to cancel for whatever reason, but if you crack the door for transfers you make an opening for scalping.

That has to be illegal from a court or lawyer's perspective - especially for purchasing something sight unseen ?

Then I shall use a credit card that will stand behind me in a chargeback in case Slate won't allow me to transfer to a family member or friend, if I bail after the $300 and before the purchase.

There's this exam that I have to take today. It's good to know that I can retake it tomorrow morning if I fail. 😅 Can't wait to see the log of all the delivery windows!

You could order the truck and then sell it to them for the same price.
